Classic Crockery Rental Agreement

These terms and conditions apply to a Renter who order’s online, in person, by email or over the telephone.

The normal rental period for crockery and accessories is 1- 4 days up to a maximum period that may not normally exceed 30 days. Any extension to the rental period must be agreed and specified in the new rental agreement, extra charges may apply. Unauthorised extensions to the rental period will be charged at the current rates plus a daily £50 penalty. The minimum charge for any rental is £75.00.

Classic Crockery agrees to rent crockery and accessories to the Renter for the period stated in the rental agreement. The rented goods shall at all times remain the property of Classic Crockery. The Renter is responsible for the rented goods during the rental period that commences from the time the goods are collected by the Renter or delivered to the Renter by Classic Crockery. The hire period finishes when the goods are returned by the Renter or collected by Classic Crockery. For the avoidance of doubt, goods returned by a 3rd party such as by post or courier are not counted as returned until Classic Crockery have signed for them.

Delivery and Collection

Classic Crockery charge £20 to deliver and collect within 20 miles of Sunbury-on-Thames. The Renter is welcome to collect and return goods to Classic Crockery by appointment. Deliveries / collections outside this are charged at charged at 0.40p per mile.

A Renter who wishes to have goods delivered / collected within London Congestion Charge zone are charged at the prevailing rate. If parking charges are incurred by our delivery / collection vehicle these will be retrospectively deducted from the deposit.

When the goods are delivered to the Renter, the Renter shall inspect the goods and sign Classic Crockery’s Rental Agreement and delivery note. In the event of any missing or damage, the Renter shall note this on the delivery note at the time of delivery or collection. If the Renter fails to do this, the goods will be deemed to have been delivered / collected in a clean and undamaged condition. If no one is available to check the items, again the items will be deemed to have been delivered / collected in a clean and undamaged condition.

When Classic Crockery collects the rented goods, it should be properly packed as found. If Classic Crockery feels the crockery is not safe for transit and has to re-pack the crockery, this will incur additional charges of £15 per half hour. Please make sure you place packing materials between all plates or use the packaging supplied.

Wash Up Service

All goods supplied by Classic Crockery are clean and ready to use. If the Renter opted to wash used goods themselves and the goods have not been cleaned to a satisfactory level we reserve the right to charge 15% of the Rental fee after we have notified you by email or phone.

Terms of Payment

When a Renter places an order, Classic Crockery ask for a non-refundable deposit of 50% of the Rental fee within 21 days of the event, if an order is placed within 7 days of the event Classic Crockery would ask for 100% of the Rental fee which is not refundable. If the Renter cancels the order for whatever reason the damage deposit and washing up fee will be refunded but not the 50% of the Rental fee if you cancel within 21 days and none of the Rental fee if you cancel within 7 days. No goods are considered confirmed until a deposit has been paid.

The £100 refundable damage deposit is charged at the time of hire, this will be returned once goods have been returned and checked for any damage or loss. The Renter will be informed within a maximum of 4 working days if there is any damage, missing or substituted items. Missing and or damage to the rented goods will be charged at the prices below and deducted accordingly from the Renters damage deposit.

£10.00 per china items (cups, saucers, bowls, small jugs) £40.00 per cake stand (glass or china), £35.00 per china tea pot or coffee pot, £7.00 per knives, forks, spoons, £15.00 for tea strainer, tongs, serving utensils, £20.00 per large platters, £15.00 medium size platters, £5.00 per tea plate, £7.00 per dinner plate, £30.00 for ice bucket, £140 for punch bowl, table cloth £39.00 per large size, £20.00 for medium size, £15.00 for small size.. Please ask for replacement costs for other items not listed.

Interest which Classic Crockery will add every day to any amount Renter does not pay Classic Crockery on time, at the rate of 4% a year above the base lending rate of National Westminster Bank Plc.

On demand, Classic Crockery’ costs, including reasonable legal fees where permitted by law, incurred in collecting payments due from Renter under the Agreement. Value added tax and all other taxes and levies on any of the charges listed above, as appropriate. Renter is responsible for all charges, even if he has asked someone else to be responsible for them. If it is Renter’s intention to pay by credit card or charge card then Renter’s signature on the Agreement shall constitute authority for Classic Crockery to compute and debit the final total charges against Renter’s account with its specified card-issuing organisation, including charges due as a result of loss of, or damage to the goods.

Liability

Classic Crockery’s total Liability to the Renter under and/or arising in relation to any agreement shall not exceed 2 times the amount of the Rental and charges for Services (if any) under that agreement or the sum of £500 whichever is the higher.

Classic Crockery shall have no Liability to the Renter if, without just cause, any monies due in respect of the rented goods have not been paid in full by the due date for payment.

Nothing in this Contract shall exclude or limit the Liability of the Supplier for death or personal injury due to the Supplier’s negligence nor exclude or limit any other type of Liability which it is not permitted to exclude or limit as a matter of law.

Any defective rented goods must be returned to the Supplier for inspection if requested by the Supplier before the Supplier will have any Liability for defective Hire Goods.

Governing law
The Agreement is governed by the laws of England. Any dispute may be submitted to the non-exclusive jurisdiction of the English courts. If any provision of this Agreement is or becomes invalid or unenforceable the remaining provisions shall not be affected.

WHAT PERSONAL INFORMATION DO WE COLLECT FROM YOU AND HOW?

Classic Crockery collects personal information in several ways when you place an order, buy a gift voucher for a friend or register for a service offered by CLASSIC CROCKERY. If an order is placed with us, we and our trusted 3rd party payment provider Sage Pay need to hold personal information including your name, email address, phone numbers, home address, shipping and credit card billing address(es) so that we can process and fulfil your order, these will be held securly and within The Payment Card Industry Regulations (PCI). Additionally we may also obtain information as a result of authentication or identity checks via Callcredit Limited a Credit Reference Agency. Sometimes we may ask for your telephone number. This number may be given to our courier for delivery services. These details allow us to process your order and to let you know the status of your order.

OTHER INFORMATION WE COLLECT THROUGH OUR SERVICES

As a user of our services, we may collect non-personal data about use of the website, such as pages visited, times and volume of use of the services as well as Traffic Data. Traffic data includes logs, details of networks, time of log-on or access, length of sessions and similar systems data.

WHAT ABOUT COOKIES?

Our site uses cookies to keep track of how often you visit our site, the contents of your shopping cart, previous purchases and to deliver content specific to your interests. (A cookie is a piece of information that is stored on your computer's hard drive by your web browser which tracks your movements within websites.) When you register with CC, you will be automatically opted into our newsletter and update email service. The information you provide will allow us to alert you to new products, features and enhancements; special offers; upgrade opportunities; contests and events of interest. Similarly, from time-to-time we will use the information you provide to promote the products and services of other companies within the DB or our business partners. We do collate statistical information about site traffic, sales and other commercial information which we may pass on to trusted third parties but these statistics do not include any information which can identify you personally. We see this as a value-added service helping you to find useful products or services. We strive to limit use of your information to those offers that we think you would appreciate receiving. We will only collect personally identifiable information to the extent deemed reasonably necessary to serve you in view of our legitimate business purposes as set out above, and we will use our best endeavours to maintain appropriate safeguards to ensure the security, integrity and privacy of the information you have provided us with. When you place an order or access your account information, we use a Secure Socket Layer (SSL) encryption hosted by our payment processor Sage Pay in accordance with the PCI Regulations which encrypts your information before it is sent to us to protect it from unauthorised use.
